Gharavian: Officials Should Drop Strict Rules That Cause Hardship for People; The Prophet Did Not Expect Them Beyond People's Capacity

A university and seminary professor said people are truly under economic pressure now: prices are high, inflation is present, incomes are low, and expenses are high, with prices rising at a staggering pace. Officials must take these issues into account in managing the country. Otherwise, they will get the opposite result, and this situation will provoke a public reaction.

According to the report of Ambassador Arjan Mohsen Ghoruyan, professor of the field and university, referring to the economic pressures on the people and proposing some social strictures such as what is heard about the hijab from public forums or the closing of some cafes and sports facilities on the pretext of not complying with the standards of the hijab, he stated: We have a rule in jurisprudence called the "important and important" rule. According to this rule, when there is a conflict between an important matter and an important matter, one should give up the important matter and deal with the important issue.

Officials should abandon the strictures that cause hardship and embarrassment to the people

According to Ilana's narration, he continued: Now the conditions of the country are such that we have to categorize and grade the issues and see which issue is important and which issue is important. Considering the specific conditions of the country, we should make the important issue the same as national unity and unity and put aside other important issues for the time being and think about preserving the important issue.

This university professor added: I raise this point from the point of view of jurisprudence; Governance should be based on this rule. There are many important issues, but we also have important issues, and in certain situations like the current situation of the country, important issues should be prioritized, and as I said, the important issue in the current situation is national unity and cohesion.

Referring to the jurisprudential rule "Al-Misour la Yatrak Bal-Masour" he said: Another point is that in the principles of jurisprudence, our scholars, including Sheikh Ansari, have discussed this rule and we teach it to students and scholars. The meaning of this rule is that whenever something is possible, we should not leave it with something that is impossible, that is, to the extent that you can implement something, and leave something that is impossible, which means that it is difficult and embarrassing, and it causes problems and causes people difficulty and embarrassment.

He added: According to this rule, the authorities should see what causes hardship and embarrassment and creates problems for people and what is easy and does not cause problems. The officials and trustees of governance should prioritize the things that can be done for the people and leave aside the things that cause hardship and hardship to the people.

This faculty and university professor stated: "Al-Misor La Yatrek Bal-Masor" means that what is easy and possible should be done and what creates problems for the system, society and people and causes difficulty and hardship should be left aside. Therefore, policymakers and officials should follow this rule and see what issues are problematic for people in the current situation, so that they can be put aside for the time being and do things that are possible and easier for people.

The legislator should consider people's ability in making decisions and policies

Referring to a narration from the Prophet of Islam, Ghorayan said: I raise these issues from an Islamic and jurisprudential point of view. Because the duty of jurists and scholars is to inform the authorities of religious and Islamic knowledge in relation to social issues so that they move in the right direction.

He continued: In a narration of the Prophet of Islam (PBUH), it is stated: That is, when I give you an order, do it to the best of your ability. This is a very important point; The Prophet does not expect more from people than they are capable of and he says to do as much of a task as you can and do not impose on yourself what is beyond your power.

This professor of the field and university emphasized: the laws, regulations, and tasks that the government determines should be inspired by this religious teaching and not in such a way as to put more pressure on the people with strictness; Because people may not be able to implement some of these regulations.

Ghorayan noted: When the legislator approves a law that is not within the power of the people, that law will not be implemented and the people will ignore it. Because they don't have the ability to implement it, and when they don't have the ability, they don't have the task, and when they don't have the task, they don't do it, and this issue can increase social crises. Therefore, based on these jurisprudential rules, the legislative officials, the executive branch and all those who are in charge of managing the society, should consider the ability of the people and their conditions in their decisions and policies.

Legislators should not only see the minority as having the loudest voice

Ghoruyan, further emphasizing the necessity of paying attention to the economic conditions of the people in the legislation and implementation of the laws, said: the officials should note that the implementation of the laws should be within the power of the people. Another point is that people should not be pressured; Because the Prophet of Islam (PBUH) says that he does not want to put pressure on people. Now, we, who are not prophets or beyond them, should not put pressure on the people in making laws and implementing laws.

He continued: People are really under economic pressure now; Prices are high, there is inflation, people's incomes are low, their expenses are high, and prices are skyrocketing. Officials must observe these issues in managing the country; Otherwise, they will be photographed and this situation will cause people to react.

This professor of the field and university stated: The law that should create order and discipline in the society may be violated due to these conditions and as a result, chaos will be created in a sense.

In response to the question of how much social strictures can increase people's dissatisfaction and anger, and whether all people should be considered in legislation and social interactions, not just a certain group or spectrum, Ghorayan said: People participate in elections and the majority vote for one person, for example the president. We must respect this majority in social interactions and legislation.

He added: Of course, there are majorities and minorities in all countries of the world. This majority shows itself in the elections. In our country, when we talk about people, we mean all people. The law is for all people and all human beings who live in a society, but clearly the majority should be considered.

This field and university professor emphasized: Legislators and administrators should consider the considerations of all people, especially the majority, not just the minority who may have a louder voice and shout more. The people who remain silent may be in the majority; Therefore, in making decisions, the interests of the country and public interests should be respected according to the wishes and conditions of the majority of the people.
