A New Look at Oversight in Hamadan: The Inspection Organization Alongside the People

Ambassador Arjan of the Provinces Group: In today's world, the efficiency of the administrative system, the health of executive structures, and the protection of public rights depend more than anything on efficient, continuous, and law-based supervision, and supervisory institutions play a vital role as vigilant observers of society in preventing deviations, fighting corruption, and promoting social capital.

The General Inspection Organization, as the highest supervisory arm of the judiciary, has a serious mission on its shoulders, which can be seen in the protection of the treasury, supporting the creation and closing of loopholes for violations and lawlessness, and Hamedan province, as one of the important centers of the western part of the country, has witnessed a significant development and a new approach in the field of supervision, inspection and interaction with the media and public opinion in recent months.

The transition from the guidance approaches of the past months to the phase of decisive disciplinary, administrative and criminal actions indicates a significant change in the level of follow-up of claims at the provincial level.

The new supervisory approach is not only limited to the issuance of punitive orders, but also has an active presence in the field of supporting production and the local economy, removing barriers to production units, reclaiming abandoned lands and enclosed behind concrete walls in industrial towns and the agricultural sector, dealing with large-scale tax evasion, blocking unauthorized wells, etc., all indicate the fact that effective supervision, along with the protection of clean managers and the economic cycle, is a decisive red line against the violation of rights. It has a treasury.

In an interview with Mehr's reporter, the head of the inspection organization of the 4th region of the country, referring to the measures taken to rebuild and strengthen the relationship of this complex with the surrounding environment and media, said: In recent months, efforts were made to reflect the news and information of the inspection in a targeted manner in the official news agencies, so that the public opinion becomes more familiar with the missions of the inspection organization.

Ishaq Shahbazi announced the implementation of awareness and publicity projects in different parts of Hamadan city, including Bimah Square, Imam Khomeini (RA) Square, and Baba Taher Square and said: with the support of the respected Imam Juma and Imams of Juma at the city level, efforts were made to introduce the importance of public supervision and the use of legal capacities to the people.

He pointed to the capabilities of the 100 and 36 systems and added: citizens can register complaints, grievances and issues and problems of the province in this system with or without a birth certificate, and we firmly believe that monitoring should be universal and people should not be indifferent to their surroundings.

The head of the inspection organization of the 4th region of the country, referring to the detailed and daily monitoring of the media and provincial websites, noted: as soon as public reports or journalists' concerns are published, including the issue of turn-based sales in bakeries or non-compliance with rules and regulations in some swimming pools of the province, a special investigation order is immediately issued and the relevant reporter is contacted to fulfill the demands of the people by receiving evidence and evidence.

In another part of his speech, he mentioned the scope and inclusion of the inspection organization based on Article 2 of the law establishing this organization and said: Our scope of supervision includes all ministries, organizations, non-governmental institutions and institutions, municipalities, organizations and management institutions specified in the Public Accounts Law, such as the Advertising Organization, the Martyr Foundation, the Relief Committee, Endowments, military, law enforcement and security forces, as well as government companies.

Shahbazi, referring to the breadth of the supervisory scope of this institution, stated: Unlike the Court of Accounts, which supervises only companies with more than 50% government shares, the Law of the Inspection Organization specifies that if a company has even one percent of government shares or is subject to government supervision, this organization will have the legal right to enter and supervise it.

Referring to the cultural challenges of evading supervision in the country, he added: Unfortunately, some institutions do not want to be supervised, and last year we faced challenges in entering private banks and Islamic Azad University.

He stated: This year, nearly 37 scheduled inspections and 6 extraordinary inspections have been implemented in Hamedan province to follow up the preventive role and fight against corruption in administrative bodies.

Referring to the legal position of the inspection organization, Shahbazi clarified: This organization is not considered a judicial officer, but as a supervisory body and public prosecutor, it refers its reports to the prosecutor's office, and the prosecutor also refers the report to the investigator, and the investigator makes a decision with full judicial independence after examining the invitation of experts and hearing the defenses of the parties.

The head of the Inspection Organization of Region 4 of the country, referring to the continuity of surveillance activities in various conditions, including special and war conditions, said: Citizens can register issues and violations through communication systems so that the inspectors of the organization can enter into the matter and follow up on it with reference to Article 2 of the Law on the Establishment of Inspection Organizations.

He named the main product and output of this organization as monitoring reports and emphasizing that the suggestions of the inspection organization have a strong legal and binding basis, he stated: The law clearly states that the highest authority of the executive body is obliged to provide the implementation arrangements for the suggestions of the inspection organization within 10 days.

Shahbazi emphasized: Failure to implement the recommendations of the inspection organization without a legal and court-friendly reason is subject to criminal prosecution, and the judicial authority and the prosecutor's office will take legal action against disgruntled managers who refuse to implement the law and reform matters.

Emphasizing that the inspection organization adheres to the protection of the rights of citizens and the rights of the accused before making a one-sided judgment, he added: According to the executive regulations of the organization, before referring the case to the judicial authorities or administrative violation boards, the inspectors are required to raise doubts with the person in question, obtain and document their written explanations and defenses so that no one's rights are lost.

Entry of inspection organization into the phase of legal and criminal dealings with violators

The head of the inspection organization of the 4th region of the country further emphasized that no document is a closed door for the inspection organization and announced the three-fold increase in violation and crime reports and said: With the expiry of the deadline for warnings and training of managers, we have entered the phase of legal, disciplinary and criminal actions.

Referring to the preventive measures of this organization in critical areas from months ago, he said: due to the possibility of gas outages in winter and the reduction of the country's gas capacity under certain conditions, since 2 months ago, official warnings and letters were sent to oil product distribution managers, senior political managers of the province and power plants to immediately fill alternative fuel tanks, and in the field of crisis management and prevention of possible accidents, explicit orders were given for dredging the rivers and rivers. It was issued by the responsible agencies and municipalities in the city limits.

Shahbazi, presenting statistics on the process of surveillance cases, stated: Last year, a total of 13 or 14 reports of violations or crimes were registered in this area, but in the last 7-8 months, this number has tripled to 39 cases.

He added: In the past months, the inspection organization's approach was based on guidance, awareness and warning, but since the necessary reforms were not made in some areas, now we have entered the phase of disciplinary and criminal actions and referral of cases to the violation authorities.

The head of the inspection organization of the 4th region of the country noted: Unfortunately, the highest frequency of violations is related to the area of municipalities, which is not limited to the center of the province and is observed in different cities.

Ignorance of the law is the root of many administrative violations

Emphasizing that most of the violations are caused by ignorance of the law and unfamiliarity with the duties, Shahbazi said: the inspection organization does not play a role as a watchdog, but rather seeks root prevention, and for this reason, several hours of specialized training courses have been held for all managers and deputy directors of banks and insurance companies in the province, as well as all mayors and deputy mayors of the provinces.

Emphasizing that the inspection organization is the auxiliary arm of executive bodies in the conditions of economic war, he said: In the last 6 months, more than 40 field visits have been made to the production and industrial units of the province, and their problems in the areas of banking, taxation, social security and energy have been followed up and resolved by holding joint meetings.

The head of the inspection organization of the 4th region of the country noted that, in addition to the inherent duty of monitoring and dealing with violations, the inspection organization considers itself obligated to protect clean managers, preserve human capital, and support the country's production cycle and economy.

The set of approaches and actions described by the head of the inspection organization of the 4-country region paints a picture of a dynamic, intelligent and transformational surveillance system. Passing from the traditional view of "punching" to the value-creating approach of "prevention, education and protection" shows the deep understanding of the regulatory body about the requirements of good governance in the current critical situation.

Also, emphasis on continuous training of managers and elimination of ignorance of the human and administrative costs law minimizes violations, and decisive and reckless dealing with omissions, tax evasions, and abuse of funds manifests the red line of the regulatory body in protecting public rights.
