Buying and selling marriage loans; A risky transaction behind the line of facilities

How is buying and selling of marriage loans done and what are the risks? Investigating the informal market of selling loan points, FATA police warning and banking and legal risks of these transactions.

According to Ambassador Arjan Saf, a marriage loan is not just a bank expectation for many young couples; Sometimes it becomes a difficult financial decision. A couple who is eyeing several hundred million tomans of Qarz Al-Hasna loan facility to start their life together, may face offers to "sell loan points" after registering and being on the path to receiving a loan. An offer that appears to be a way to get cash quickly, but behind it, there is a set of banking and legal ambiguities.

Searching for terms such as "marriage loan buyer" or "marriage loan sale" in cyberspace will still bring the audience to offers that advertise for the purchase of facility points. Domestic media reports have also announced the formation of such a market and even the price for marriage loan points in the past years.

But the main question is: when the marriage loan is defined for the qualified person, can another person buy the privilege from the applicant by paying money?

In whose name is the marriage loan paid?

As the Nafs Press news site wrote; The executive instructions of Qarz-ul-Hosna marriage facility in 1405 defined the applicant as a qualified Iranian person who registers his application in the system and after going through the specified steps, the facility is paid to him.

In the same instruction, a facility of 300 million tomans is provided for each couple, and for couples subject to the age requirement, this figure reaches 350 million tomans. Also, for some subjects of the comprehensive law on providing services to veterans, the facility ceiling is different.

The structure of this facility has been designed from the beginning based on a specific applicant, a specific bank, validation and guarantee; That is, the loan is not a general amount that can be bought and sold, that any person can take it from another person.

When "loan credit" becomes a commodity

In the informal market, what is being bought and sold is usually referred to as "loan credit"; A person who is eligible to receive the facility, in exchange for receiving an amount less than the loan amount, is willing to provide the possibility of receiving the facility to another person.

Media reports about the market have indicated that these deals are sometimes conducted through online advertisements and public platforms. In some older reports, even for marriage loans, certain amounts have been suggested as "royalty".

The appearance of the story is simple: one person needs immediate money, and the other needs facilities that cannot be received directly. But the main issue here is that the bank is not a party to the transaction between these two people.

The seller gets paid, but the debt is still in his name

One of the most important risks of such a deal is the repayment issue. Officials have also warned about the purchase and sale of marriage loans that the consequences of not paying the installments can affect the person in whose name the facility was received.

That is, even if there is a private agreement between two people, this agreement does not necessarily change their contractual relationship with the bank. The bank has paid the facility based on the case of the same applicant and the repayment obligations have been formed within the framework of his banking relationship.

This is where a deal that at first seems like a simple agreement for quick access to money can turn into trouble for both parties.

FATA Police: Loan ads on cyberspace are not allowed

The new FATA police warning shows other dimensions of this market. Sardar Vahid Majid, head of FATA police, warned on 17 Mehr 1405 about the advertisements of providing financial facilities in cyberspace and announced that none of the advertisements of providing loans in cyberspace and ad-based platforms are licensed.

According to the head of FATA police, the licenses related to granting loans and financial facilities should be provided by the central bank and within the framework of authorized centers, and public platforms should not be the place to publish such advertisements. He also announced a warning to platforms that publish such ads.

This warning is not just for "loan sale" ads; Rather, it has a clear message for applicants: any offer that is presented in cyberspace as an instant loan, loan purchase or facility transfer is not necessarily an authorized banking service.

A transaction that may remain separate from the bank

In the domestic legal sources, it is emphasized about the transfer of marriage loan points that this facility is protective and personal in nature, and its transfer to another person, without the bank's permission and within the framework of banking regulations, cannot be relied upon.

To put it more simply, the private contract of two people cannot alone oblige the bank to change the actual recipient of the facility.

Even if the seller and the buyer come to an agreement, the main issue still remains: the bank must know to whom and for what purpose the facility was paid and who is responsible for the resulting obligations.

The risk is not limited to non-transferability of points. When the transaction is done in an informal environment, there is a possibility of misusing identity documents, receiving money before the transaction, providing false information or using fake documents.

Legal sources have warned about these transactions that if false documents or statements are used during such a process, depending on the behavior, there is a possibility of criminal charges such as fraud or forgery.

In such a situation, a person who thinks he has found a shorter way to access a loan by paying an amount, may not only not get the facility, but also lose the principal of the money paid.

Why is the buying and selling market formed?

The existence of such a market cannot be seen separately from the financial needs of young couples and the problems of accessing financial resources. On the one hand, there are applicants who, due to their urgent need for money or their inability to cover the costs of starting their lives, are willing to give up their points with an amount lower than the nominal value of the facility.

On the other hand, people may also be looking for a way to access financial resources faster and imagine that buying a loan score can shorten the path to receiving facilities.

In the meantime, waiting lines, limited resources, issues related to guarantees and banking process can make informal offers more attractive; But the economic attractiveness of a transaction does not mean its bank or legal approval.

What young couples should know before any transaction

The official route of the marriage loan passes through the relevant system and the operating bank. After registering, selecting a bank, specifying a branch, filing, validating and presenting documents and guarantees, the applicant will receive the facility if the conditions are met.

On the other hand, a transaction that is done outside of this process and between two people is a different matter and should not be confused with the official transfer of facilities from the bank.

"Buy Marriage Loan" offers online should also not be considered valid just because they are published on a site or platform. The recent FATA police warning about the lack of permission for loan advertisements on public platforms touches on exactly this point.

A loan that was supposed to be a life support

The marriage loan is supposed to cover part of the expenses of starting a joint life; But when its privilege enters the informal market, the support function of the facility is tied to a risky transaction.

On one side of this market is a couple who may need cash to cover immediate living expenses, and on the other side, a person who thinks they can find a short cut to a loan by paying a certain amount. Between these two, however, there is a bank that pays the facility according to the regulations and in the name of the qualified applicant.

This distance between the private agreement of individuals and their official relationship with the bank is the most important part of the story of buying and selling marriage loans. A gap that can be ignored can create a cost for the parties much higher than the transaction amount.
