Imran Khan is preparing a court to challenge an order giving the Bollywood actor until October 28 to leave India after he participated in a protest demanding the resignation of Election Commission chief Ginesh Kumar.

Bollywood superstar and Aamir Khan's nephew, Khan is an American citizen living in India on an Overseas Citizen of India (OCI) card. It was at his home in Mumbai's Khar neighborhood that the Foreign Resident Registration Office (FRRO) handed over the notice, a police officer said. The petition, which calls India's exit announcement "extreme", is expected to reach the Bombay High Court on Friday. Its main contention is that nothing in Indian law or OCI regulations bars a cardholder from taking part in a protest. Police arrested more than 400 people across Mumbai on October 10, many of them at August Kranti Maidan, where demonstrators had gathered in solidarity with the Susk Janata Party (CJP) rally in Delhi. Delhi's agitation centers on allegations that voter rolls were tampered with during a special intensive revision exercise. According to the police, no one has been given a permit for the Mumbai event and Azad Square is the only place where the Bombay High Court allows protests in the city.

Speaking to reporters before his arrest, Khan said that he had no demands. "I'm here as a citizen, as someone who lives in this city," he said.

Police also arrested his girlfriend, actress Lekha Washington, and his cousin Zain Marie Khan. From inside the van, Khan shared an Instagram selfie with the caption, "Looks like I'm going for a drive." He had also participated in the CJP's July protest.

The Gamdevi police have since filed a first intelligence report naming Khan among the accused. Former Bharatiya Janata Party (BJP) MP Krit Somaiah filed a complaint with the same station, alleging that Khan's presence at the rally violated the terms of his OCI status and visa, and the police forwarded it to the FRRO. Soumaya, who wants Khan's arrest and deportation and has accused him of "political extremism", separately on October 13 sought a circular from Union Home Minister Govind Mohan declaring any attempt by Khan to leave India.

No OCI rules deal with whether cardholders can object, and revocation of OCI status is a separate process from a declaration of departure from India. The Union Home Ministry has already used this power and canceled the OCI card of Kannada film actor Chetan A Kumar, who is also a US citizen, for "anti-Indian activities".

Khan retired from acting after a string of films that included 'Delhi Belly', 'The Only Brother Ki Dulhan' and 'I Hate Luv Stories', making his debut in 2008's Aamir Khan-produced Jaan Tu Ya Jaan Na. He also directed the 2018 short Mars Mission: Keep Walking India. He is set to make a comeback to acting with 'Adhure Hum Adhure Tum'.
