Salehi: Prisoners Unable to Post Bail Should Be Identified as Soon as Possible

The Tehran prosecutor announced an order to identify detainees who are unable to provide bail or a guarantor, and to review solutions for securing their guarantees and resolving their problems.

According to the report of Ambassador Arjan Ali Salehi, Tehran prosecutor, in the meeting related to the unveiling of the electronic bail system, pointed out the need to identify people who are in prison due to the inability to present a surety or guarantor, and stated: It has been announced to the prisons organization, including the prisons of Tehran province, that the people who are in custody due to the inability to present a surety or guarantor should be identified as soon as possible.

He added: There should be a discussion with these people about the possibility of providing a guarantee, and their information should be reported to the relevant authorities for follow-up and investigation of solutions to the problem.

Referring to the beginning of the implementation of the electronic bail system in the Tehran prosecutors' offices, the Tehran prosecutor said: The trial implementation of this system began on the first of Shahrivar 1405 in three Tehran prosecutors' offices, and from the 22nd of Shahrivar, all prosecutors' offices of the city and province of Tehran joined this system.

Stating that the successful implementation of this plan required coordination between different departments of the judiciary and executive bodies, Salehi said: Central Bank, Tax Affairs Organization, Real Estate and Document Registration Organization, Administrative and Employment Organization of the country and Social Security Organization cooperated effectively in the implementation of this plan. Also, the efforts of the first deputy of the Judiciary, the Attorney General of the country, the head of the Statistics and Information Technology Center of the Judiciary and other officials and experts played an important role in advancing this project.

Referring to the holding of five specialized meetings with managers of related institutions, he stated: In these meetings, the problems in the process of providing online services were examined and 41 resolutions were approved to remove technical and executive obstacles, and the necessary measures were taken to implement them.

The Prosecutor of Tehran considered the stability of the services of the Tax Affairs Organization as one of the main axes of corrective measures and said: due to the necessity of continuous access to information, the stability of the services of this organization was emphasized on holidays and outside office hours, and the problems related to this department were followed up and resolved.

Salehi added: Due to the lack of up-to-date property price information in some regions of the country and parts of Tehran, it was decided to upload the new information and prices within a week at most, so that the property valuation process can be done more accurately.

Referring to the reduction of errors in the electronic guarantee system, he noted: the amount of errors at the beginning of the implementation of the plan was about 30%, which has now reached less than five percent with the corrective measures and elimination of existing disturbances. Most of the technical problems of the first stages of system implementation have been solved with the cooperation of the responsible institutions.

Regarding the planned measures to prevent disruptions in the provision of electronic bail services, the Tehran prosecutor said: For each of the cooperating devices, a specific person has been designated as a dedicated liaison and support, so that direct and continuous communication between that device, the Statistics and Information Technology Center of the Judiciary and other related departments is established and possible problems are followed up in the shortest possible time.

In another part of his speech, Salehi considered the identification of prisoners who are unable to present a surety or guarantor as one of the necessary measures in order to use the capacities of this system and emphasized: the situation of these people should be investigated as soon as possible so that if it is possible to provide a guarantee, the existing obstacles will be followed up and legal solutions to solve their problems will be investigated.

About the electronic warranty system

The electronic bail system has been launched with the aim of reducing the number of prisoners due to failure to provide bail on time, facilitating and speeding up the process of securing and accepting bail for the release of the accused, improving administrative health in the process of securing judicial appointments and increasing client satisfaction.

Among the advantages of this system, we can mention speeding up the process of providing collateral, transparency and automatic validation of introduced assets, eliminating in-person referrals and reducing traditional methods, reducing human error in asset registration and recording, intelligent evaluation of real estate prices based on transaction value, and online identification of mortgageable properties. It is also possible to seize and remove the seizure of property online within the framework of the foreseen processes.

In this system, after the announcement of bail by the judicial authority, the applicant can register a request to identify his assets. The system identifies the property that can be used as collateral online, and after selecting the asset and requesting its seizure in the amount of the issued order, the necessary steps are taken to accept the collateral. Finally, with the approval of the judicial authority, the person will be released.

Also, third parties can apply for the acceptance of the guarantee and their property information through the judicial electronic service offices or the automated system of Iran's justice to secure the bail of the accused or convicted person. After the confirmation of the third party and the identification of the property, the property in question will be confiscated to the extent of the bail, and after the approval of the procedures and the acceptance of the bail by the judicial authority, the person will be released.
