The resolution "facilitating access to foreign platforms and promoting lawful governance", known as the 32-band resolution, was declassified and published publicly today, according to the announcement of the secretary of the Supreme Council of Cyberspace. This document was supposed to pave the way for the opening of WhatsApp, Google Play, YouTube, Telegram and other foreign platforms in four stages, and at the same time, more strictness will be imposed on the use of filter breakers; But following the two wars and the events of January 1404, the reopening process stopped and even WhatsApp, which had been unfiltered for a while, was blocked again.
According to Ambassador Arjan, the published text of the resolution shows that the Supreme Council of Cyberspace had designed the facilitation of access to foreign platforms not as an independent program to remove filtering, but as a package of protective, economic, legal and security measures; A package that placed the reopening of foreign platforms alongside the strengthening of domestic platforms, the development of the national information network, and the intensification of dealing with filter breakers.
This resolution was approved in the 140th session of the Supreme Council of Virtual Space on 4 January 1403, and its additional amendments were approved in the 150th session on 23 February of the same year. The stated goal of the document was to "provide the legitimate and legal needs of the people in accessing content and services while promoting lawful governance." Until now, this resolution was not available to the media and people and remained confidential and only parts of it had reached the media.
According to this resolution, in the first stage, Google Play and WhatsApp were supposed to be reopened. At the same time, the Ministry of Communications was required to provide the infrastructure required for the selected domestic content platforms, and Sedavosima to consider an advertising support package worth 500 billion tomans for these platforms. The announcement of network traffic tariff policies and content revenue sharing was also predicted at this stage.
The second phase included the reopening of YouTube "based on lawful governance" and the beginning of partnerships and negotiations with external platforms, with an emphasis on new platforms. Of course, the document does not specify the main device and the partner in the row related to the reopening of YouTube.
In the third stage, it was Telegram's turn: the Ministry of Communications had to negotiate with this platform, and its reopening was conditional on accepting the conditions of the steering group.
The document also considered another path in case of failure of negotiations; "Reopening of Telegram based on legal governance", without specifying the details of the mechanism or device responsible for this action in the table. It seems that what was meant by lawful governance was the launch of Telegram skins and platforms like YouTube.
The fourth stage was devoted to the reopening of other platforms after negotiating and accepting the conditions of the working group. The names of these platforms are not mentioned in the document.
A significant part of the approved action plan was dedicated to supporting domestic platforms. The services of electronic prescriptions, SMS of bank transactions and communication of devices with clients were supposed to be provided exclusively on selected internal messengers. In the next stage, services related to subsidy, fuel card, police and judiciary were added to this list.
Prohibiting the official use of devices from foreign platforms, except in exceptional cases, and requiring them to be present on domestic platforms were also other measures foreseen.
In addition to these cases, the resolution of the Ministry of Communications required the economic model of operators to be modified in order to reduce the income from foreign traffic compared to domestic traffic and to improve the speed, stability and user experience of domestic platforms with technical advantages. Investments to create content and service platforms in areas that do not have a strong domestic example were also included in the plan.
This document also linked a series of legislative measures to the reopening process; From the approval of the bill to deal with fake news in the government and the follow-up of its two-urgent review in the parliament, to the formulation of the platform responsibility law and the intellectual property law.
In the fourth stage, it was planned to draft a bill to criminalize the supply and sale of "governance-evading tools", to improve the ability to deal with filter breakers, to prevent tax evasion of income from activities in foreign platforms, and to intensify dealing with crimes and violations in unauthorized foreign platforms.
Therefore, the council's roadmap was not simply to open access to a few services; Its implementation should have simultaneously changed the regulatory structure, support for internal services and restriction tools, and it was supposed to ban the use of filter breakers and deal with "violations" on foreign platforms more severely than what we are facing now.
The management of this program was entrusted to a working group chaired by the head of the National Cyber Space Center and the secretary of the Minister of Communications. Representatives of the Parliament and the Judiciary, the Minister of Information, a representative of the Islamic Revolutionary Guard Corps, the Attorney General of the country and two real members of the Council were also present in its composition.
This working group had to approve the operational plan and schedule of actions and after ensuring the full implementation of each stage, it would give permission to enter the next stage. Determining the negotiation process and confirming the agreement with foreign platforms was also the responsibility of this working group.
The resolution also allowed the working group to issue an order to return to the previous steps or actions if it detects a violation, defect or failure in implementation. However, the published text alone does not make it clear whether the current suspension of re-opening or re-blocking of WhatsApp is based on this task force's decision or some other mechanism.
This program was supposed to expand access to foreign platforms gradually and within the framework of the set conditions, but subsequent developments took a different path. Two wars and the events of January 1404 stopped the reopening process and even access to WhatsApp, which had been open for a while, was blocked again.
Now the program to reopen foreign platforms has practically stopped; However, this suspension cannot be considered as the suspension of all the support, legal and infrastructure tasks included in the resolution.
In such an atmosphere, neither the Iranian side nor the foreign platforms seem to have a clear desire to start or resume negotiations, and the promising prospect for the implementation of the section related to the reopening of foreign platforms is completely unclear.
