official registration of transactions; Judicial health axis

Stating that the implementation of the law requiring the official registration of real estate transactions is a legal and strategic duty, the Chief Justice of Lorestan said: The implementation of this law plays an important role in ensuring the security of transactions and improving the legal health of the society.

He added: The official registration of real estate contracts and transactions must be done through legal channels and in official document offices. Because accurate and legal registration of transactions can prevent the formation of disputes and lawsuits in the future.

Separation of duties of real estate consultants and notary offices

Referring to some challenges of implementing this law, Alimohammadi clarified: real estate consultants must operate within the framework of their legal duties and be responsible for drafting contracts; On the other hand, the final and official registration of transactions is in the jurisdiction of notary offices.

The role of electronic systems in preventing violations

Emphasizing the role of notaries in preventing violations, this judicial official added: Connecting notary offices to electronic systems of registration and transparency of transaction information can limit the occurrence of violations such as money laundering, land grabbing, sale of other's property, and conflict of interests.

He pointed out: accurate recording of information and smart monitoring of transactions is effective in preventing disputes caused by conflicting transactions and reducing the number of cases brought to the courts.

Notaries; Impartial advisers of the transaction parties

Chief Justice of Lorestan emphasized the guiding role of notaries and stated: Notaries should guide the parties to the transaction to choose the correct legal forms as impartial advisors.

He added: Part of the judicial disputes is due to people's ignorance of the legal effects of contracts such as sale and peace agreement. Therefore, the detailed explanation of the provisions and legal consequences of contracts can prevent conflicts in the future.

The necessity of creating a culture about the official registration of transactions

At the end, Alimohammadi emphasized the need to increase public awareness and asked the members of the Notaries Association to explain to the people the importance of official registration of transactions using the capacity of the media and radio.

He considered the professional health of notaries to be one of the effective factors in improving judicial health and emphasized: the judicial system seriously supports the implementation of the law requiring the official registration of real estate transactions in order to reduce court cases and increase the legal security of the society.
