Conditions for Clearing Imported Cars Owned by Iranians Abroad Announced

An executive directive on clearing imported vehicles owned by Iranian residents abroad has been issued.

According to Mehr's reporter, the executive instructions on how to clear imported cars belonging to Iranians living abroad were announced by the Iranian customs.

According to this directive regarding the clearance of these cars, considering the necessity of timely clearance of imported cars as well as protection of the rights of the government until the determination of the value of items that do not have a TSC value identifier in the Iran Customs Value Information Bank, if the car owner requests the clearance of the goods before announcing the opinion of the working group, in order to adopt a unified approach, special measures must be taken, including the obligation to pay any possible difference in import duties on the part of the goods owner, limit the numbering of the car and refrain from registering the vehicle registration number. In the comprehensive system of customs affairs and confirmation of the exit trip in the new system, he pointed out.

The full text of the circular is as follows: Following directive No. 1405/1024678 dated 19/07/1405 regarding the clearance of imported vehicles belonging to Iranians residing abroad and considering the necessity of timely clearance of imported vehicles and protection of the rights of the government, it is decided until the determination of the value of cars that do not have a TSC value identifier in the Iran Customs Value Information Bank, in case the owner of the goods requests the clearance of the vehicle before announcing the opinion of the working group, in order to create unity procedure, the following steps should be taken:

A commitment to pay any possible difference in import duties should be obtained from the owner of the goods. The text of the commitment is as follows:

"I, as the owner of the goods subject to the customs declaration, undertake to pay the difference immediately after the notification to the customs if the declared value of the car is found to be less than the inferred value determined by the working group subject to note (6)."

2. Registration of warnings in the comprehensive system of customs affairs

In the comprehensive system of customs affairs, a warning message in red color that the numbering of the cleared car is subject to the determination of the value of the car by the working group subject to note (6) of article (12) of the law on organizing the automobile industry and the announcement of the executive customs to collect the possible difference of the due funds and to close the case.

3. Refusal to issue a vehicle exit permit

Executive customs, after completing the customs formalities, should refrain from issuing the so-called exit registration certificate in the Comprehensive Customs Affairs System (EPL) or exit travel confirmation in the new system (IRICS).

4. Coordination for moving the car

In order to facilitate the transfer of the car from the customs premises to the warehouse of the owner of the goods, the status of the car's exit from the executive customs should be announced to the Faraja Economic Security Police through an administrative correspondence.

5. Pursuing the determination of the customs value of the car

Executive customs, according to the past procedure, by entering the detailed specifications of the vehicle based on the attached file, reflect this to the Iranian customs valuation office. Also, a copy of the correspondence should be sent to the local customs review unit so that the related file can be followed until the final result is obtained.

6. Action regarding cleared vehicles without TSC ID

Regarding the cars that have been cleared from the place of approval related to Iranians residing abroad, but do not have TSC ID, the executive customs should stop the legal time period and, if possible, issue a demand letter for the amount of the due funds.

7. Collecting the difference and closing the case

After determining the value of the car by the working group and creating the TSC ID in the Iran Customs Value Data Bank, the executive customs are obliged to collect the possible difference of the due funds and close the case. After that, issuing a passport in the comprehensive system of customs affairs or confirming the exit trip in the new system. Also, the situation must be certified by the director or deputy of customs affairs of the executive customs office, by writing the words "noticeable by the traffic police" on the customs declaration.
